Just how is the legislation worded?

I'm guessing that the quick and easy way to get rid of "bad", excessively snoopy or "illegal" cookies, is to use Flash LSOs or web-bugs to do the same thing.

The law is not restricted to cookies but rather to any form of tracking, so web-bugs would be in violation as well. It's going to be interesting to watch how this plays out from here across the pond.

Now is this applying only to European servers, or to European users too?

I say that because I am reminded of problems Yahoo had (long, long ago, in a galaxy etc) when delivering search results on American servers that contained Nazi references to users in France where such references are illegal.

This is a UK law so only the UK is impacted at this point.

As has been said, many times and in many ways, France has a very different legal system than the "common law" countries of the Anglosphere.
