I tried to use the "Contact US" link but the topics are confined to selling and using ebay only. I suspect someone a little more official might need to contact them regarding this.

It is, after all, slander using graphic images.

I thought about contacting them under the fraudulent listing category. I do think an email will be forthcoming from me in the morning.

I'm afraid we can't find any penguins who know how to type a cease and desist letter. Or don't they own the portrait-right?

No it's still there, it's on the shirt of the "Play dunk the scammer" man at http://pages.ebay.com.au/protectyourself/ he's wearing a red shirt with tux on the front.

I filed my complaint with eBay AUS this morning. I probably should have been more diplomatic about it, but it was early in the morning. I received a reply that I should have a response within 24-36 hours. I advised them that if it is not removed, I shall be canceling my eBay (US) account as well as my PayPal account.

Perhaps an open letter is in order? 1. This is a complete and outright slanderous image. Anyone wearing a T-shirt or other item with an image of Tux will now be associated with crackers and Phishers. 2. Whoever put this image together knew what they were doing. They should pay with the loss of their job! 3. They are not giving proper tribute to Larry Lewing for the use of the Tux image. 4. Add your valid points to this post so we can draft up a public letter to ebay...

4. Linux as a platform for security research (as opposed to a certain proprietary OS from Redmond with very limited security policy options) 5. eBay is using Windows 2000. If Microsoft is so great, why hasn't eBay upgraded to XP or Vista? 6. Linux as an attack platform is much less common than Windows of any flavor, or even Macintosh OS X. 7. Storm worm, anyone? It's even spreading to YouTube videos! Yet, when was the last time you heard of Storm living on a Linux system? 8. Why not any of the BSD flavors or OpenSolaris? Is eBay deliberately choosing a platform licensed under the GPL? If so, why? Or, more pointedly, at whose direction? 9. Was eBay compensated for the negative portrayal of Linux? If so, by whom? As a publicly-traded company, eBay must make such financial transactions to shareholders.

The Tux shirt is just one of some geeky shirts worn by scammer characters in the flash game. This isn't against Linux as much as it is against geeks (although apart from the shirts we look nothing like the characters in the game, of course).

It is interesting that those who usually know much more about security than the average computer user, and who use that knowledge for good, are portrayed as criminals by eBay. Obviously they don't have any geeks working for them, which means using their sites might not be a very good idea if your money things for sale and are worth anything to you. And if they do have geeks working for them... well, guys, your employer just insulted you. Time to write a letter of resignation?

I, for one, have now decided never to send my resume to eBay, and I will not use their services either. I won't do business with someone who does not respect my subculture.

I finally found a "improve eBay suggestion", where my letter said basically "If not a Windows logo, or a Mac logo, why Tux?"

I don't expect they will reply with anything more rational than a form letter.

(Sorry I missed it the first time, but it is quite small and so "normal" for me that it didn't cause a blip on the radar.)

I've just sent a mail to the Linux-aus mailing list, to see if anything can be done about it, but based on my last experience with them I don't expect anything more than abuse in return.

They have changed the images. Looks like they also offended some Star Wars fans, but no fans of the blue screen of death :) .

I'm curious if there will be any apologies... probably not. Well, I'm still not going to do business with them, then.
