They could be more succinct.

It would seem a fair suggestion that MS obviously viewed it as a benefit for the presumably patents to be infringed. otherwise they would surely have had to act on the share holders behalf immediately upon discovery. In relation to that you have to suggest that as it (Linux) is their competitor and they have full access to the source code they should always be vetting it and alerting the authors of anything they think infringes. Otherwise as they have good time to do so it seems unfair to then make claims against it.
