...as SCOX itself being wrong since Day One.

Once that's clearly understood, courts can start thinking about recompensing the many people harmed by SCOX's (choice of) malicious or grossly careless claims SCOX has made over every random technology they thought they could possibly reach.

Now THAT would "steak" this particular money-vampire rather effectively.

Yeah, something the article fails to mention is that SCOG's claims were not dismissed on merit, but dismissed because SCOG did not actually point out what material they claim was misused. The mantra from the beginning has been, "show us the code", so the reasonable conclusion is that they couldn't find any code to specify. (What happened to all that code they ran around screaming they had, to all the press, back at the beginning?) It's just that, technically, the court didn't rule on whether such code exists, only that SCOG didn't point to any in those claims that were tossed.

It's as good as if she had ruled the code doesn't exist. To have those claims thrown out as a discovery sanction -- that's very severe. Judges don't like to do that kind of thing, and will do it only under extreme circumstances. Effectively, the judge is saying, "If you had it, you would have shown it by now. You must not have it, so these claims are gone."

SCOG was required to plant a stake in their property, run a chain from it to a stake planted in IBM's property, then another chain to a stake planted in Linux. They managed to plant a few stakes, but nothing to connect them. Borrowing Vaughan-Nichols analogy, the judge planted a stake in SCOG, instead.

In addition to your summing up the Linus community mantra, "show us the code" remebmer that the Judge also pointed out SCOX's often repeated response.

"Oh, we have code! Mountains of it. Even a layman will be able to se the line for line copying!"
