Why would patents be more of a problem for Linux than for Windows? Microsoft has had its share of patent infringements.

Simple.... Microsoft has billions of $ to hire lawyers and fund patent lawsuits. Linux developers tend not to have the deep pockets needed to defend against frivolous lawsuits.

One would only hope that the big boys (IBM, etc.) would have an interest in defending Linux.

One other problem is that if your source code is secret it becomes much more difficult to find violations of copyright or patents.
